The incident began around 2:40 p.m. Oct. 10, when an elderly woman entered a Bank of the Sierra branch to withdraw a large sum from her account, the Ventura County Sheriff’s Office reported Monday. Police services in Fillmore are provided by the agency.

A man, later identified as 63-year-old Nelson Davila Cruz, of Los Angeles, entered the bank while the woman was getting the cash, according to authorities. Cruz seemed to have an unusual interest in the woman and her transaction, authorities said, which prompted bank employees to notify the sheriff’s agency.

Patrol deputies and detectives got to the bank and contacted Cruz as he was “scurrying out” of the branch, according to an account from the sheriff’s agency.Deputies interviewed the woman, who told them a man and a woman asked her to help them cash a winning lottery ticket, saying they needed “good faith” money to cash it, authorities said. They handed her a cellphone, and a man on the other end impersonating a lawyer corroborated the phony story.

Detectives said they determined that Cruz was working with the unidentified man and woman. He was arrested on suspicion of felony conspiracy, obtaining money by false pretenses and elder abuse offenses, authorities said. While he was being booked into Ventura County jail, authorities found he had a felony warrant from another county for grand theft by embezzlement and was a suspect in a Long Beach lottery scam case, authorities said.

Deputies and detectives arrived before the victim handed over the money, authorities said.

Cruz was released from jail Saturday on a $75,000 bail bond, records show. He is scheduled to appear in Ventura County Superior Court on Oct. 28.
